Toxic Torts
Toxic Torts
Peter has successfully handled an array of toxic tort claims involving lead-based paint, carbon monoxide poisoning, mold, toxic spills, and industrial chemicals and solvents. He has represented clients facing these types of claims: Personal injuries including cancers and “chemical sensitivities”; property damage claims relating to cost of remediation and repair; alleged design and construction errors leading to claimed contamination; and alleged failure to identify and remedy alleged hazards.
Success in a toxic tort claim requires both legal knowledge (particularly on how courts handle scientific matters) and technical knowledge on the “toxic” substance at issue in a case. Further, the science and the law in this area can be complicated, and it is essential to have an attorney that can communicate and engage the experts on scientific matters, and explain difficult concepts as they apply to resolution.
